Terms and Conditions

Last updated: 24 July 2026

These Terms and Conditions apply to the use of boilerlines.co.uk and to the purchase of products from Boiler Lines.

Please read these Terms and Conditions carefully before placing an order.

By placing an order through our website, you confirm that you have read and accepted the terms that apply to your purchase.

Nothing in these Terms and Conditions limits or excludes your statutory rights under applicable UK law.

1. About Boiler Lines

Boiler Lines is a trading name of:

Legal company name: DYS FORTEX LTD
Trading name: Boiler Lines
Company number: 15246219
Company type: Private Limited Company
Incorporated: 30 October 2023
Registered office: C/O Elstree Consultants Ltd, 4 Imperial Place, Maxwell Road, Borehamwood, England, WD6 1JN

In these Terms and Conditions, “Boiler Lines”, “we”, “us” and “our” refer to DYS FORTEX LTD.

The registered office is a correspondence address and is not automatically an authorised product-return address.

Products must not be returned to this address unless we have provided prior written authorisation.

2. About These Terms

These Terms and Conditions explain:

  • How you may use our website;

  • How orders are placed and accepted;

  • How prices and payments are handled;

  • How products are delivered;

  • Your responsibilities when choosing and installing products;

  • How cancellations, returns and refunds are managed;

  • How product faults and manufacturer warranties are handled;

  • Our respective responsibilities if something goes wrong.

Additional policies forming part of your relationship with Boiler Lines include our:

  • Returns, Refunds and Cancellation Policy;

  • Delivery Information;

  • Warranty Information;

  • Privacy Policy;

  • Cookie Policy;

  • Complaints Procedure.

Where there is a conflict between these Terms and a product-specific term clearly shown before you place your order, the product-specific term will apply to the relevant issue.

Your statutory rights always take priority where they cannot lawfully be limited or excluded.

3. Consumer and Business Customers

Some provisions in these Terms apply differently depending on whether you are a consumer or a business customer.

A consumer is an individual purchasing goods wholly or mainly for personal use rather than for a trade, business, craft or profession.

A business customer includes:

  • A limited company;

  • A partnership;

  • A sole trader purchasing wholly or mainly for business use;

  • A heating engineer;

  • An installer;

  • A property developer;

  • A landlord purchasing as part of commercial activity;

  • A trade-account customer;

  • Any person purchasing on behalf of a business.

Statutory consumer cancellation rights do not normally apply to purchases made wholly or mainly for business purposes.

If you place an order on behalf of a business, you confirm that you have authority to bind that business.

4. Products Sold by Boiler Lines

Boiler Lines sells products including:

  • Boilers;

  • Boiler flues;

  • Boiler filters;

  • Thermostats;

  • Heating controls;

  • Boiler accessories;

  • Related heating products.

Products may be supplied individually or as part of a package.

The contents of a package will be stated in the relevant product description or order confirmation.

A product image may show accessories, controls, fittings or decorative items that are not included. You should review the written product description and package contents before ordering.

5. No Installation Service

Boiler Lines does not provide installation, removal, commissioning, servicing or repair services unless expressly agreed in a separate written contract.

Your purchase from Boiler Lines is for the supply of products only.

You are responsible for arranging installation and commissioning through appropriately qualified professionals.

Gas appliances must be installed and commissioned by a suitably qualified Gas Safe registered engineer where required by law.

Electrical work must be carried out by a suitably qualified person.

Boiler Lines delivery personnel:

  • Do not install products;

  • Do not disconnect existing appliances;

  • Do not remove old boilers;

  • Do not commission products;

  • Do not modify pipework or wiring;

  • Do not determine whether a product is suitable for your property.

6. Product Suitability

You are responsible for checking that a product is suitable for your property, heating system and intended use before ordering and before installation begins.

This may include checking:

  • Boiler type;

  • Fuel type;

  • Heat output;

  • Hot-water requirements;

  • Property size and heat-loss requirements;

  • Product dimensions;

  • Flue type and position;

  • Pipework requirements;

  • Electrical requirements;

  • System pressure;

  • Control compatibility;

  • Filter compatibility;

  • Accessory compatibility;

  • Manufacturer installation requirements.

We strongly recommend obtaining advice from a suitably qualified heating professional before placing an order.

Information provided on our website is intended to assist product selection but does not replace a property-specific survey, heat-loss calculation or professional assessment.

Do not arrange installation if the product appears incorrect, damaged, unsuitable or incompatible.

7. Product Descriptions

We take reasonable care to ensure that product descriptions, specifications and compatibility information are accurate.

However:

  • Manufacturers may change specifications;

  • Packaging may be updated;

  • Product appearance may vary slightly;

  • Colours may appear differently on different screens;

  • Minor design changes may occur without changing the product’s essential function;

  • Manufacturer information may be updated after a product is listed.

The product supplied will be required to match its description in all material respects.

Where a substitution would materially change the product, package contents, functionality or value, we will not make the substitution without contacting you and obtaining your agreement.

8. Product Images

Product images are provided for illustration.

Images may not show the exact scale, colour or complete package contents.

Logos, accessories, controls, flues, filters and fittings shown in promotional images are included only where confirmed in the written product description or order summary.

You should not rely solely on an image when determining technical compatibility.

9. Product Availability

All orders are subject to product availability.

Adding an item to your basket does not reserve stock.

If a product becomes unavailable after you order, we may:

  • Offer a revised delivery date;

  • Offer a suitable alternative;

  • Offer to remove the unavailable item from the order;

  • Cancel the affected item;

  • Cancel the full order where the remaining items cannot reasonably be supplied separately.

We will not provide an alternative product without your agreement where it materially differs from the product ordered.

If you do not accept an alternative or revised delivery arrangement, we will refund any amount paid for the affected product.

10. Placing an Order

To place an order, you will normally be required to:

  1. Select the required products;

  2. Add the products to your basket;

  3. Review the basket and quantities;

  4. Provide billing and delivery details;

  5. Select an available delivery option;

  6. Select a payment method;

  7. Review the total price;

  8. Correct any errors;

  9. Confirm that the order requires payment;

  10. Submit the order.

You are responsible for checking the order carefully before submitting it.

Before placing the order, you should verify:

  • Product model;

  • Boiler type;

  • Kilowatt output;

  • Fuel type;

  • Package contents;

  • Quantity;

  • Billing address;

  • Delivery address;

  • Contact details;

  • Delivery charge;

  • Total order value.

11. Order Acknowledgement

After you submit an order, we may send an automated email confirming that we have received it.

An order acknowledgement does not necessarily mean that we have accepted your order.

It records that the order has been submitted and is being reviewed or processed.

We may carry out checks relating to:

  • Payment authorisation;

  • Product availability;

  • Delivery eligibility;

  • Delivery address;

  • Fraud prevention;

  • Pricing accuracy;

  • Order information;

  • Customer identity where reasonably required.

12. When the Contract Is Formed

A binding contract between you and Boiler Lines is normally formed when we send an order acceptance or dispatch confirmation.

Taking or authorising payment does not necessarily mean that we have accepted the order.

If we cannot accept an order, we will inform you and refund any payment taken.

Reasons we may be unable to accept an order include:

  • The product is unavailable;

  • Payment cannot be authorised;

  • The delivery address is outside our service area;

  • The product or price was incorrectly listed;

  • We reasonably suspect fraud or misuse;

  • An order quantity restriction applies;

  • We cannot safely or reasonably complete delivery;

  • You do not provide information reasonably required to process the order.

We will not refuse a consumer order for an unlawful or discriminatory reason.

13. Order Confirmation

Once the order is accepted, we will provide confirmation in a format you can retain, normally by email.

The confirmation may include:

  • Order number;

  • Products ordered;

  • Price paid;

  • Delivery charge;

  • Billing address;

  • Delivery address;

  • Payment method;

  • Relevant policies;

  • Cancellation information;

  • Estimated delivery information.

You should retain the confirmation and invoice as proof of purchase.

14. Customer Accounts

You may be able to create a customer account through our Shopify-powered website.

You are responsible for:

  • Providing accurate information;

  • Keeping account details current;

  • Keeping login credentials confidential;

  • Preventing unauthorised access;

  • Informing us if you suspect account misuse.

You must not:

  • Create an account using false information;

  • Impersonate another person;

  • Access another customer’s account;

  • Share passwords in a way that creates a security risk;

  • Use an account for fraud or unlawful activity.

We may suspend access where reasonably necessary to protect the customer, Boiler Lines or another person.

Account suspension does not remove rights relating to an existing order.

Customer-account information is handled in accordance with our Privacy Policy.

15. Prices

Product prices will be displayed on our website.

Unless clearly stated otherwise, prices shown to consumers will include VAT where VAT is applicable.

Delivery charges will be displayed separately or included in the total before the order is submitted.

The final checkout page will show the total amount payable before you confirm the order.

Prices may change at any time, but a change will not normally affect an order that we have already accepted.

16. Pricing Errors

We take reasonable care to display accurate prices.

Occasionally a product may be listed with an obvious pricing, promotional or technical error.

If we identify an error before accepting the order, we may contact you and offer the option to:

  • Proceed at the correct price;

  • Select an alternative;

  • Cancel the order.

If the correct price is lower, we will charge the lower amount.

If the pricing error is obvious and could reasonably have been recognised as a mistake, we may cancel the affected order even after an automated acknowledgement has been sent.

Any payment taken for a cancelled item will be refunded.

We will not use this clause to change an agreed price arbitrarily after a contract has been formed.

17. Promotional Prices and Discount Codes

Promotions may be subject to additional terms displayed with the relevant offer.

Unless otherwise stated:

  • Promotions are available for a limited time;

  • Discount codes cannot be exchanged for cash;

  • A code may be restricted to one use per customer;

  • Codes may apply only to selected products;

  • Multiple codes may not be combined;

  • A code may exclude delivery charges;

  • Orders must satisfy any stated minimum spend;

  • Discounts may be withdrawn before an order is placed.

We may refuse or cancel a discount where it has been obtained or used fraudulently.

If part of a discounted order is returned, the discount may be recalculated based on the products retained and returned.

18. Payment Methods

Available payment methods may include:

  • Shopify Payments;

  • Klarna;

  • Debit or credit cards supported through Shopify Payments;

  • Other methods displayed at checkout.

Payment availability may depend on:

  • Order value;

  • Customer eligibility;

  • Delivery address;

  • Payment-provider requirements;

  • Fraud and security checks.

We do not guarantee that every payment method will be available for every order.

19. Shopify Payments

Payments made through Shopify Payments may be processed by Shopify, its payment partners, banks and card networks.

Payment providers may carry out:

  • Card authorisation;

  • Identity checks;

  • Fraud screening;

  • Security checks;

  • Payment processing;

  • Refund processing;

  • Chargeback management.

A payment may be refused or held by the payment provider.

Boiler Lines is not responsible for a payment-provider decision that it does not control, but we will provide reasonable assistance concerning the Boiler Lines order.

20. Klarna

Klarna may be offered as a payment option to eligible customers.

Klarna is responsible for its own:

  • Eligibility assessment;

  • Identity checks;

  • Credit or affordability assessment where applicable;

  • Payment-plan terms;

  • Payment schedules;

  • Account management;

  • Late-payment processes;

  • Financial-service decisions.

Selecting Klarna creates a separate payment relationship between you and Klarna under Klarna’s applicable terms.

Boiler Lines remains responsible for fulfilling the product order in accordance with the sales contract.

If an order paid through Klarna is refunded, the refund will be submitted through the Klarna transaction. Klarna will update the payment plan or account under its procedures.

Questions concerning Klarna’s credit, payment or account decisions should be directed to Klarna.

21. Payment Authorisation

You confirm that:

  • You are authorised to use the selected payment method;

  • Payment information is accurate;

  • Sufficient funds or credit are available;

  • You will not knowingly submit a fraudulent payment.

We may delay dispatch while a payment or security check is completed.

Where payment is reversed, refused or recalled without lawful justification, we may suspend fulfilment and seek payment of sums properly due.

Nothing in this section limits rights relating to legitimate chargebacks, card protections or consumer remedies.

22. Delivery Areas

Boiler Lines delivers only to postcodes and areas that it currently serves.

Delivery availability will be confirmed through the website, checkout process or direct communication.

Submitting an order does not guarantee that the delivery address is within our service area.

If we cannot deliver to the address provided, we will contact you and may cancel the order.

The detailed list of eligible postcodes, exclusions, delivery costs and arrangements will be provided in our Delivery Information.

23. Delivery Method

Boiler Lines currently intends to deliver products primarily using Boiler Lines vehicles and delivery personnel.

We may use an approved logistics or delivery provider where reasonably necessary.

Delivery may be subject to:

  • Vehicle access;

  • Road restrictions;

  • Parking availability;

  • Safe unloading conditions;

  • Product size and weight;

  • Property access;

  • Delivery-area availability;

  • Customer availability.

Delivery personnel do not provide installation, commissioning or removal services.

24. Delivery Times

Estimated delivery dates or time windows are estimates unless we expressly agree that a particular date is essential.

We will take reasonable steps to deliver within the agreed period.

Where no specific period has been agreed, consumer orders will be delivered within the period required by applicable law.

Delivery may be affected by events outside our reasonable control, including:

  • Severe weather;

  • Road closures;

  • Vehicle breakdown;

  • Traffic disruption;

  • Supplier delays;

  • Product shortages;

  • Industrial action;

  • Safety incidents;

  • Government restrictions;

  • Other unexpected events.

We will inform you of a material delay and explain the available options.

25. Information Required for Delivery

You must provide accurate:

  • Recipient name;

  • Delivery address;

  • Postcode;

  • Email address;

  • Telephone number;

  • Access instructions;

  • Relevant delivery restrictions.

Boiler Lines is not responsible for delay caused by materially incomplete or incorrect information supplied by the customer.

If you identify an error, contact info@boilerlines.co.uk as soon as possible.

We cannot guarantee that an address can be changed after dispatch or route planning has begun.

26. Access and Safe Delivery

You must ensure that the delivery location:

  • Is reasonably accessible;

  • Can be reached safely by the delivery vehicle;

  • Has a safe unloading area;

  • Is free from avoidable hazards;

  • Has sufficient access for the product;

  • Is attended by an adult authorised to accept delivery, where required.

You should tell us in advance about:

  • Narrow roads;

  • Height or weight restrictions;

  • Controlled-access areas;

  • Parking restrictions;

  • Stairs or access difficulties;

  • Construction works;

  • Restricted delivery hours;

  • Any other relevant obstacle.

We may refuse to complete delivery where doing so would create an unreasonable safety risk.

27. Delivery Point

The applicable delivery point will be explained in our Delivery Information or confirmed before delivery.

Unless a different service has been expressly agreed, delivery does not include:

  • Installation;

  • Removal of doors or fittings;

  • Carrying products through unsafe access;

  • Lifting products over obstacles;

  • Moving unrelated goods;

  • Taking a product to an upper floor;

  • Removing an existing appliance;

  • Removing packaging after delivery.

The customer is responsible for arranging any specialist movement required after delivery.

28. Failed Delivery

A delivery may be treated as failed where:

  • No authorised person is available;

  • Access cannot be obtained;

  • The delivery address is incorrect;

  • The location is unsafe;

  • The product cannot reasonably be unloaded;

  • Relevant restrictions were not disclosed;

  • The customer refuses delivery without a valid reason.

Where reasonably permitted, we may charge the actual and reasonable cost of a further delivery attempt.

We will not impose a disproportionate or automatic penalty.

If the customer is a consumer, any charge or cancellation outcome will remain subject to statutory rights and fairness requirements.

29. Inspection on Delivery

You or an authorised recipient should inspect the external packaging when the product is delivered.

Where possible, check:

  • Number of packages;

  • Product model;

  • Visible packaging damage;

  • Signs of impact;

  • Missing items;

  • Obvious product damage.

Visible issues should be reported to the delivery person and recorded before the vehicle leaves where reasonably possible.

A delivery signature confirms receipt. It does not automatically confirm that the goods are fault-free or remove statutory rights concerning hidden damage, faults or incorrectly supplied goods.

30. Delivery Damage

If a product appears damaged:

  • Do not install it;

  • Do not connect it;

  • Do not discard the packaging;

  • Take photographs;

  • Contact info@boilerlines.co.uk promptly.

Where reasonably possible, delivery damage should be reported within 48 hours.

The 48-hour reporting request helps us investigate the delivery and preserve evidence. It does not remove statutory rights where a report is made later.

Further information is provided in our Returns, Refunds and Cancellation Policy.

31. Risk in the Goods

For consumer orders, responsibility for accidental loss or damage normally passes to you when:

  • You receive physical possession of the goods; or

  • A person identified by you, other than our carrier, receives them.

Where you arrange your own carrier and that carrier was not offered by us, risk may pass when the goods are delivered to that carrier, as provided by applicable law.

Nothing in these Terms transfers risk earlier than permitted by consumer law.

32. Ownership of the Goods

Ownership of the goods normally passes to you when:

  • We have received payment in full; and

  • The goods have been delivered.

For business customers, we may apply additional retention-of-title provisions under separately agreed trade terms.

33. Cancelling Before Dispatch

You may ask to cancel an order before dispatch by contacting:

info@boilerlines.co.uk

We will make reasonable efforts to stop fulfilment.

Because orders may be processed quickly, cancellation cannot be guaranteed after warehouse preparation, route planning or dispatch has begun.

If the goods have already been dispatched, the cancellation will be handled under our Returns, Refunds and Cancellation Policy.

34. Consumer Cancellation Rights

Consumers purchasing online normally have the right to notify us that they wish to cancel within 14 days beginning on the day after the goods are received.

After giving notice, the goods must normally be returned or made available for collection within a further 14 days.

Further information about:

  • How to cancel;

  • Return authorisation;

  • Product condition;

  • Collection costs;

  • Heavy-product returns;

  • Refund timing;

  • Refund deductions

is provided in our Returns, Refunds and Cancellation Policy.

Nothing in these Terms reduces the statutory cancellation period.

35. Change-of-Mind Returns

Change-of-mind returns must normally be:

  • Unused;

  • Uninstalled;

  • Uncommissioned;

  • Unconnected;

  • Complete;

  • Appropriately packaged;

  • In a condition consistent with reasonable inspection.

Opening packaging solely to inspect a product does not automatically remove cancellation rights.

However, we may make a lawful deduction where handling beyond what is reasonably necessary has reduced the product’s value.

Products that have been installed, connected, filled, commissioned, altered or used cannot normally be accepted as change-of-mind returns.

This does not affect rights concerning faulty or incorrectly supplied products.

36. Return Costs

Where a consumer returns goods because they have changed their mind, the consumer will normally be responsible for the direct return cost, provided this was properly disclosed.

Boilers and heating appliances may require specialist collection due to their size and weight.

Where Boiler Lines arranges a change-of-mind collection:

  • The collection charge will be explained in advance;

  • The charge will reflect reasonable direct collection costs;

  • The agreed amount may be deducted from the refund where lawful.

Boiler Lines will normally cover reasonable return costs where goods are:

  • Faulty;

  • Damaged during delivery;

  • Incorrectly supplied;

  • Not as described.

37. Refunds

Refunds will normally be made using the payment method used for the original transaction.

Where legally required, a consumer refund will include:

  • The price paid for the returned goods;

  • The cost of the least expensive standard delivery method offered for the original order.

Additional amounts paid for express, timed, premium or enhanced delivery will not normally be refunded beyond the standard-delivery amount.

Refund timing and deductions are explained in our Returns, Refunds and Cancellation Policy.

38. Faulty Goods

Products supplied to consumers must be:

  • Of satisfactory quality;

  • Fit for their intended purpose;

  • As described.

If you believe a product is faulty, contact:

info@boilerlines.co.uk

Do not carry out an unauthorised repair or return the product without instructions.

We may request reasonable evidence to identify the problem, including:

  • Photographs;

  • Videos;

  • Error codes;

  • Product serial number;

  • Installation documents;

  • Commissioning records;

  • Engineer details;

  • A professional report where reasonably necessary.

Requesting information does not remove statutory rights.

39. Consumer Remedies

Depending on the circumstances, consumer remedies for faulty goods may include:

  • Short-term rejection;

  • Refund;

  • Repair;

  • Replacement;

  • Price reduction;

  • Final rejection.

A consumer may have a short-term right to reject qualifying faulty goods within 30 days of delivery.

After the first 30 days, the consumer may normally be required to allow an opportunity for repair or replacement before receiving a price reduction or final refund.

The precise remedy will depend on applicable law and the circumstances of the fault.

40. Installation-Related Issues

A product is not necessarily faulty because it does not operate correctly after installation.

A problem may be caused by:

  • Incorrect installation;

  • Incorrect commissioning;

  • Incorrect product selection;

  • System incompatibility;

  • Existing pipework;

  • Existing wiring;

  • Incorrect flue configuration;

  • External controls;

  • Poor water quality;

  • Sludge, scale or contamination;

  • Incorrect system pressure;

  • Failure to follow manufacturer instructions;

  • Damage caused during installation.

Where an inspection confirms that the product is not faulty, reasonable inspection, collection or redelivery costs may be charged where lawful and explained.

Nothing in this section excludes responsibility for goods that were faulty when supplied.

41. Manufacturer Warranties

Boiler Lines does not provide its own commercial product warranty unless expressly stated in writing.

Products may include a warranty provided directly by the manufacturer.

Warranty duration and eligibility vary according to:

  • Manufacturer;

  • Product;

  • Model;

  • Installer qualification;

  • Registration;

  • Commissioning;

  • Annual servicing;

  • Water treatment;

  • Use of approved accessories;

  • Manufacturer terms.

Manufacturer warranty claims will normally be handled directly between the customer and manufacturer.

Further details are provided in our Warranty Information.

42. Statutory Rights and Manufacturer Warranties

A manufacturer warranty is additional to statutory rights.

It does not replace rights against Boiler Lines as the retailer.

You may contact Boiler Lines where:

  • The goods were faulty when supplied;

  • The goods were not as described;

  • You received an incorrect product;

  • The product arrived damaged;

  • You wish to exercise a statutory right;

  • The manufacturer directs you to the retailer;

  • You require proof of purchase.

43. Warranty Registration

Where manufacturer warranty registration is required, the customer and installer are responsible for ensuring that registration is completed accurately and on time unless we expressly agree otherwise.

Customers should retain:

  • Boiler Lines invoice;

  • Product serial number;

  • Completed Benchmark documentation;

  • Installation records;

  • Commissioning records;

  • Gas Safe documentation;

  • Warranty registration confirmation;

  • Annual service records.

Failure to meet manufacturer requirements may affect the commercial warranty.

44. Website Availability

We aim to keep boilerlines.co.uk available and accurate.

We do not guarantee that the website will always be:

  • Uninterrupted;

  • Error-free;

  • Compatible with every device;

  • Free from temporary maintenance;

  • Free from technical disruption.

We may suspend or restrict access where reasonably necessary for:

  • Maintenance;

  • Security;

  • Technical changes;

  • Legal compliance;

  • Service improvement.

Website unavailability does not affect contracts already formed.

45. Website Content

General information on the website is provided for guidance.

It is not:

  • Heating-design advice;

  • A property survey;

  • A heat-loss calculation;

  • Installation advice specific to your property;

  • Gas-safety advice;

  • A substitute for professional assessment.

You should obtain appropriate professional advice before relying on technical information for installation or system design.

46. Acceptable Use

You must not use the website:

  • Unlawfully;

  • Fraudulently;

  • To submit false orders;

  • To interfere with website operation;

  • To introduce malicious code;

  • To attempt unauthorised access;

  • To scrape or copy data at an unreasonable scale;

  • To infringe intellectual-property rights;

  • To harass staff or other users;

  • To misuse live chat or chatbot services.

We may restrict access where reasonably necessary to prevent fraud, security threats or unlawful conduct.

Any restriction will not remove statutory rights relating to an existing order.

47. Intellectual Property

Unless stated otherwise, website content is owned by or licensed to DYS FORTEX LTD.

This may include:

  • Boiler Lines branding;

  • Logos;

  • Text;

  • Page layouts;

  • Graphics;

  • Product-page content;

  • Original photographs;

  • Design elements;

  • Software configuration.

Manufacturer names, logos and product images may belong to their respective owners and are used for product identification or authorised sales purposes.

You may view and print content for personal, non-commercial use.

You must not reproduce, publish, sell or commercially exploit Boiler Lines content without permission, except where permitted by law.

48. Third-Party Links

The website may include links to:

  • Manufacturers;

  • Klarna;

  • Shopify;

  • Payment providers;

  • Warranty-registration websites;

  • Other third-party services.

We are not responsible for third-party websites or their content, availability, security or privacy practices.

You should review the relevant third-party terms and policies before using those services.

49. Personal Information

Personal information is handled in accordance with our Privacy Policy.

Our website uses cookies and similar technologies as explained in our Cookie Policy.

Where required, non-essential analytics and advertising technologies will only operate after the appropriate consent has been obtained.

50. Communications

We may contact you about:

  • Orders;

  • Payments;

  • Delivery;

  • Customer accounts;

  • Returns;

  • Refunds;

  • Faults;

  • Warranties;

  • Product safety;

  • Complaints;

  • Security.

These operational communications are not marketing merely because they are sent by email or SMS.

Marketing communications will be handled according to your preferences and our Privacy Policy.

51. Our Responsibility to Consumers

Nothing in these Terms excludes or limits responsibility where it would be unlawful to do so.

This includes responsibility for:

  • Death or personal injury caused by negligence;

  • Fraud or fraudulent misrepresentation;

  • Breach of statutory rights relating to goods;

  • Goods that are not of satisfactory quality;

  • Goods that are not fit for purpose;

  • Goods that are not as described;

  • Any other liability that cannot legally be excluded.

52. Losses We Are Responsible For

If we fail to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of our breach or failure to use reasonable care and skill.

Loss is foreseeable where:

  • It was obvious that it might happen; or

  • Both parties knew it might happen when the contract was formed.

We are not responsible for losses that were not foreseeable, except where liability cannot lawfully be excluded.

53. Business Losses

Where you are a consumer, we supply products for private use.

We are not normally responsible to a consumer for business losses including:

  • Loss of profit;

  • Loss of business;

  • Business interruption;

  • Loss of commercial opportunity,

where the product was purchased wholly or mainly for personal use.

Business-customer liability may be subject to separate trade terms agreed before purchase.

Nothing excludes liability that cannot lawfully be excluded.

54. Installation Costs and Consequential Work

You should inspect and verify products before installation begins.

Unless required by law, Boiler Lines will not normally be responsible for avoidable installation, removal or reinstallation costs where:

  • The customer or installer continued despite an obvious error;

  • The wrong product was ordered by the customer;

  • Damage was visible before installation;

  • Compatibility was not properly checked;

  • Installation was completed incorrectly.

This clause does not exclude responsibility where Boiler Lines supplied faulty or incorrect goods and the relevant loss was a foreseeable consequence that the customer could not reasonably have avoided.

Each case will be considered according to its circumstances and applicable law.

55. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by an event outside our reasonable control.

Examples may include:

  • Severe weather;

  • Flood;

  • Fire;

  • Road closure;

  • Vehicle breakdown;

  • Industrial action;

  • Supplier disruption;

  • Product shortage;

  • Utility failure;

  • Cyberattack;

  • Government action;

  • Public-health emergency;

  • Civil disorder;

  • Other exceptional events.

We will:

  • Contact you where the event materially affects the order;

  • Take reasonable steps to reduce the effect;

  • Provide revised delivery information;

  • Explain available cancellation or refund rights.

If delay becomes substantial, you may have the right to cancel the affected order and receive a refund for goods not supplied.

56. Changes to an Accepted Order

After a contract has been formed, we will not make a material change to:

  • The product;

  • Price;

  • Package contents;

  • Delivery service;

  • Other important terms

without a valid reason and, where required, your agreement.

Minor changes may be made where they:

  • Do not materially disadvantage you;

  • Are required by law;

  • Address a safety or technical issue;

  • Reflect an equivalent manufacturer change without reducing quality or functionality.

Where a proposed change materially affects the order, you may reject it and cancel the affected item.

57. Transfers of Rights

We may transfer our rights or obligations under a contract to another organisation where:

  • This does not reduce your rights;

  • This does not materially disadvantage you;

  • We provide notice where reasonably required.

You may transfer your rights where permitted by law.

A manufacturer warranty may have separate transfer conditions.

58. If Part of These Terms Is Invalid

If a court or competent authority finds part of these Terms unlawful or unenforceable, the remaining provisions will continue to apply.

The affected provision will be interpreted or limited only to the extent necessary to make it lawful where possible.

59. Delay in Enforcing These Terms

If we do not immediately enforce a right, this does not mean that we have waived it.

A delay in taking action does not prevent us from doing so later, subject to applicable limitation periods and law.

This section does not allow us to revive a right that has legally expired.

60. Third-Party Rights

Unless expressly stated, a person who is not a party to the contract does not have a right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.

This does not affect rights or remedies available independently of that Act.

61. Complaints

If you have a complaint, contact:

info@boilerlines.co.uk

Please provide:

  • Your name;

  • Order number;

  • Details of the issue;

  • Relevant dates;

  • Supporting evidence;

  • The outcome requested.

Complaints will be handled under our Complaints Procedure.

Making a complaint does not affect statutory rights.

62. Alternative Dispute Resolution

Alternative Dispute Resolution may provide a way to resolve a consumer dispute without court proceedings.

Where we are legally required to provide information about an approved ADR provider, or where we agree to participate in ADR, relevant information will be provided in our final complaint response.

Unless expressly confirmed, Boiler Lines does not commit through these Terms to use a particular ADR provider.

63. Governing Law for Consumers

These Terms and consumer contracts are governed by the laws of England and Wales.

A consumer may bring proceedings in the courts of the part of the United Kingdom where they live, where applicable.

Nothing in this section removes mandatory rights available under the law of the consumer’s place of residence.

64. Governing Law for Business Customers

Contracts with business customers are governed by the laws of England and Wales.

Subject to any separately agreed trade terms, the courts of England and Wales will have exclusive jurisdiction over disputes involving business customers.

65. Changes to These Terms

We may update these Terms to reflect:

  • Changes to law;

  • Changes to our services;

  • Changes to payment methods;

  • Changes to delivery arrangements;

  • Changes to our website;

  • Changes to our business operations.

The terms applying to an order will normally be those available when the order was placed, unless a change is required by law or agreed with you.

The latest version will be published on boilerlines.co.uk and the “Last updated” date will be revised.
